Riassunto analitico
Oggi giorno, è mutato il modo in cui le imprese distinguono la propria attività. L'evoluzione del marketing e delle strategie di comunicazione ha infatti mutato il modo di fare impresa, e anche il diritto industriale ha dovuto adeguarsi alle nuove esigenze di mercato. In questa prospettiva, si inserisce il marchio sonoro che si serve di un elemento acustico per contraddistinguere i prodotti e i servizi di un'impresa. L'utilizzo di un marchio non convenzionale come quello sonoro può avere un forte impatto sul consumatore, ma pone numerose questioni interpretative sul tema della capacità distintiva e rappresentabilità grafica. Entrambe le tematiche saranno compiutamente analizzate nel corso della presente tesi, dopo aver ricostruito lo stato dell'arte e analizzato le principali decisioni, sia nazionali che europee, sul tema del marchio sonoro.

Abstract
Nowadays, the companies have changed the way to distinguish their activities. The evolution of marketing and communication strategies has developed the method of doing business, and also the intellectual property has to be adapted the these necessities. In this perspective we can remind the sound trademark which uses a sound in order to distinguish the products and services of an entrepreneur. The use of a sound trademark could have a strong impact on consumer's behavior, but rises some doubts on the themes of distinguish capacity and graphical reproduction. Both themes will be analyzed in my research thesis after having rebuilt the state of art and analyzed the main decisions, either national and European, on this subject.
