Riassunto analitico
Il progetto di ricerca intende presentare l’Analisi Testuale Contrastiva e il Diritto Comparato come metodologie per la Traduzione Giuridica. A tale proposito, la tesi si focalizza sulla sottocompetenza tematica e su quella testuale come strumenti fondamentali per la formazione di professionisti in traduzione giuridica interlinguistica e intersistemica. L’obiettivo principale del progetto è lo studio empirico, linguistico ed extra-linguistico, di un caso specifico di diritto e dei testi ad esso legati, appartenenti a generi e classi diverse. Dal punto di vista linguistico, la tesi promuove "l’analisi testuale multilivello e multidimensionale" come metodo in grado di fornire una conoscenza olistica del testo, mediante lo studio di vari livelli: funzionale, situazionale, tematico e formale-grammaticale. Dal punto di vista extra-linguistico, la tesi si concentra sul Diritto Comparato come disciplina che studia la norma mediante i suoi formanti (Sacco), ossia la legge, la giurisprudenza e la dottrina. Questi elementi si intersecano tra loro, creando discordanze tra le leggi, le sentenze e i testi dottrinali emanati dai due ordinamenti. Il caso di diritto proposto sono le Convivenze di Fatto (Parejas de Hecho) e le Unioni Civili (Matrimonios Civiles) in Italia e Spagna, poiché, sebbene i due paesi condividano la stessa tradizione giuridica, l’anisomorfismo tra questi due istituti di Diritto di Famiglia crea molteplici differenze che si riflettono nei documenti giuridici e possono influire sulla loro traduzione. Abbiamo scelto questo tema poiché rispecchia una questione attuale e sempre più importante nel dibattito politico internazionale sui diritti civili. La presente tesi si articola come segue: l’Introduzione presenta gli aspetti generali dell'argomento, l’ambito, i metodi e gli obiettivi del progetto. Il primo capitolo si concentra sul linguaggio giuridico, fornendo una panoramica sui linguaggi specialistici, i tecnoletti, le LFS e le microlingue e presenta, inoltre, le principali caratteristiche morfosintattiche e lessicali dello Spagnolo e dell’Italiano giuridico. Il secondo capitolo si concentra sul testo giuridico, con la distinzione tra tipo, genere e classe testuale e fornisce una panoramica sui principali contributi della Linguistica Testuale e della Traduttologia. Inoltre, il capitolo presenta il modello d’analisi testuale che consiste nell’analisi multilivello e multidimensionale, teorizzata da autori come Heinemann e Viehweger, Brinker, Ciapuscio e Kuguel, Elena, Roiss e Holl. Il terzo capitolo si concentra sulla traduzione giuridica, sulle sue caratteristiche principali e sulla differenza tra la traduzione giuridica, giudiziaria e giurata. Inoltre, presenta le teorie sulla competenza traduttiva, concentrandosi sull’acquisizione della sottocompetenza tematica e testuale. Il quarto capitolo presenta la metodologia del Diritto Comparato e contiene uno studio sugli ordinamenti giuridici e sul Diritto di Famiglia spagnolo e italiano, specialmente sugli istituti delle coppie di fatto e delle unioni tra persone dello stesso sesso. Il quinto capitolo consiste nell’analisi empirica dei tre corpora di testi giuridici paralleli di Diritto di Famiglia: (1) 60 Testi Normativi; (2) 30 Testi Giudiziari; (3) 22 Testi Amministrativi. Ciascuna sezione consta di un’analisi testuale multilivello separata per i testi spagnoli e italiani e di conclusioni contrastive con risultati quantitativi e qualitativi. Il sesto capitolo contiene le conclusioni finali in cui si dimostra come la conoscenza contrastiva, sia testuale che tematica, sia la base per comprendere e rispettare la struttura, le caratteristiche linguistiche e pragmatiche e il valore giuridico delle stesse classi/generi testuali in diverse culture giuridiche.

Abstract
The research project aims at presenting Contrastive Textology and Comparative Law as methods for Legal Translation. On that basis, it focuses on the acquisition of thematic and textual sub-competencies as fundamental tools for the training of specialized translators in inter-linguistic and inter-systemic Legal Translation. The main goal of the project is to conduct an empirical study, both linguistic and extra-linguistic, of a specific legal topic and its related texts, belonging to different genres and classes. From a linguistic point of view, the PhD thesis focuses on multilevel and multidimensional textual analysis as a method that allows the acquisition of an holistic knowledge of the text, by studying its functional, situational, thematic and style-grammatical levels. From an extra-linguistic point of view, the project focuses on Comparative Law as a discipline that involves the study of legal systems through their constitutive “formants” (Sacco) – legislation, case law and legal doctrine. Those elements combine and relate to each other, creating differences between enacted laws, case laws and scholarly writings of two legal systems. The proposed case study is Family Law institutions: cohabiting couples (parejas de hecho/ convivenze di fatto) and same-sex marriage (matrimonio/ unioni civili) in Italy and Spain. In fact, although they share the same legal tradition, the anisomorphism between Spanish and Italian Family Law creates multiple differences that are reflected in legal documents and can affect its translation. We chose this legal topic because it reflects a current issue of emerging importance in the international political debate on civil rights.
The present PhD thesis is structured as follows: the Introduction presents the more general aspects of the topic, focusing on the scope, methods and the objectives of the project. The first chapter focuses on the legal language, providing a general overview on LSP, specialized languages, technical languages and micro-languages. It also introduces the main morphosyntactic and lexical features of legal Spanish and Italian. The second chapter focuses on the legal text, presenting the distinction between text type, genre and class and providing an overview of the main contributions of Text Linguistics and Translation Studies. It also introduces the theory and approach to text analysis which consists in the multilevel and multidimensional model theorized by different authors like Heinemann & Viehweger, Brinker, Ciapuscio & Kuguel, Elena, Roiss and Holl. The third chapter focuses on legal translation, introducing its main features and the difference between legal, court and sworn translation. It also focuses on the translation competence, deepening on the acquisition of thematic and textual sub-competencies. The fourth chapter introduces the method of Comparative Law and provides a comparative study of Spanish and Italian legal systems and Family Law, especially the institutions of cohabiting couples and same-sex marriage. The fifth chapter consists of the empirical analysis of the three corpora of parallel legal texts of Family Law: (1) 60 Legislative Texts; (2) 30 Judicial Texts; (3) 22 Administrative Texts. Each subsection consists of a monolingual multilevel textual analysis of Spanish and Italian texts and its contrastive conclusions with quantitative and qualitative results. The sixth chapter presents the final conclusions, which prove that the contrastive knowledge, both textual and thematic, is the basis for understanding and respecting the structure, linguistic and pragmatic features and legal status of the same text classes/genres in different legal cultures.
