Lo scritto è dedicato all’analisi della tutela ambientale all’interno del diritto internazionale, europeo e nazionale. Lo scopo è quello di andare a ricostruire il percorso evolutivo della disciplina sino ad arrivare ad illustrare l’apporto della legge costituzionale n. 1 del 2022, che ha apportato modiche agli articoli 9 e 41 della Costituzione.
Il presente elaborato, dopo essersi soffermandosi su un primo inquadramento generale sulle principali problematiche legate alla definizione concettuale del termine “ambiente” e il suo intreccio con l’interesse intergenerazionale, si sofferma sugli eventi storici più significati che hanno potato all’emersione sempre maggiore della necessità di una disciplina specifica, illustrando la strada scelta della comunità internazionale, europea e nazionale al fine di poterla realizzare. Infine, con riferimento alla riforma che ha coinvolto la Costituzione nel 2022, si analizzeranno le nuove rappresentazioni dell’ambiente come principio fondamentale e limite alla libera iniziativa economica, mostrandone il valore per lo più confermativo di quanto già espresso dalla giurisprudenza della Corte costituzionale negli anni passati.

The paper is dedicated to the analysis of environmental protection within international, European and national law. The aim is to reconstruct the evolutionary path of the discipline until it comes to illustrating the contribution of constitutional law no. 1 of 2022, which made changes to articles 9 and 41 of the Constitution. This paper, after having focused on an initial general framework on the main problems related to the conceptual definition of the term "environment" and its connection with intergenerational interest, focuses on the most significant historical events that have led to the ever-increasing emergence of the need for a specific discipline, illustrating the path chosen by the international, European and national community in order to be able to implement it. Lastly, with reference to the reform that involved the Constitution in 2022, will be analyzed the new representations of the environment as a fundamental principle and limit to free economic initiative, showing their mostly confirmatory value of what has already been expressed by the jurisprudence of the Constitutional Court in past years.
