Riassunto analitico
Abstract (Italiano) La presente tesi mira ad analizzare la traduzione in italiano dell’Accordo di Parigi partendo dalla versione ufficiale in spagnolo. Come primo punto si presentano i principali aspetti teorici e pratici della traduzione come disciplina. A partire da questa esposizione, si spiegano le caratteristiche della traduzione giuridica, elemento centrale di questa tesi, e le varie tecniche traduttive utilizzate in essa. Si presentano le diverse scuole, come quella di Tel Aviv, e le diverse discipline, come gli Translation Studies. Tutti questi elementi stanno poi alla base della comparazione della versione spagnola e quella italiana di alcuni articoli dell’Accordo di Parigi, che permette di dimostrare le affinità e le differenze tra le due lingue in questione grazie all’applicazione delle teorie della traduzione previamente presentate. Quest’analisi parte anche dal riconoscimento della ricca varietà linguistica dello spagnolo che, con più di 496 milioni di parlanti, è la seconda lingua con più parlanti nativi al mondo. Questo comporta che ogni comunità linguistica ispanofona – identificata anche oltre i confini territoriali dei paesi di lingua spagnola, si pensi agli ispanofoni nati e cresciuti negli Stati Uniti – abbia delle caratteristiche proprie che possono portare ad incomprensioni anche tra i parlanti madrelingua. Per questo motivo, e per l'importanza dell’Accordo di Parigi, era necessario optare per una variante linguistica che fosse compresa da tutti e, quindi, è stato utilizzato quello che si conosce come spagnolo standard. Per quanto riguarda la versione italiana, si apprezza l’utilizzo di un registro formale ed uno stile autorevole, proprio dei documenti ufficiali. La componente linguistica è quindi di fondamentale importanza in questo elaborato. È bene ricordare che la prospettiva linguistica però non è l’unica ad essere rilevante, bensì anche quella giuridica ricopre un ruolo fondamentale. Si spiega cos’è il Diritto e in che modo il Diritto Internazionale è molto significativo in questa tesi, approfondendo il Diritto dell’Unione Europea e la sua influenza nel contesto dell’Accordo di Parigi. Per la sua importanza, si espone brevemente la differenza tra i diversi ordinamenti giuridici più comuni in occidente: il common law e il civil law, e anche come questa venga superata quando si tratta di accordi internazionali come in questo caso. Siccome l’Accordo di Parigi fa parte del sistema delle Nazione Unite, risulta rilevante e necessario spiegare come è strutturata l’Organizzazione delle Nazioni Unite (ONU) e le principali istituzioni, organismi e figure ad essa collegate in materia di protezione dell’ambiente: la Convenzione Quadro delle Nazioni Unite sui Cambiamenti Climatici, meglio conosciuta con la sigla inglese UNFCCC (United Nations Framework Convention on Climate Change) e la Conferenza delle Parti (COP). Si può quindi affermare che la presente tesi verte in ambito linguistico, in particolare sulla traduzione giuridica. A tal proposito, gli Translation Studies sono stati di fondamentale importanza negli ultimi decenni in quanto hanno permesso, grazie allo studio e alla ricerca, di rendere sempre più accessibile la traduzione in vari settori. Nonostante ciò, resta ancora un grande lavoro da fare affinché i traduttori, giuridici e non, possano servirsi di strumenti adeguati per effettuare i loro lavori. Inoltre, la componente linguistica è affiancata ad una spiegazione generica della classificazione del Diritto nei diversi settori in cui opera ponendo particolare attenzione al Diritto Internazionale, nella cui categoria rientrano i trattati internazionali come l’Accordo di Parigi. Infine, si ricorda che l’analisi comparata delle due versioni, fulcro principale di questo elaborato, si trova dopo la parte teorica linguistica e del Diritto affinché il lettore possa avere delle conoscenze di base per comprendere l'analisi nell'ultimo capitolo.

Abstract (English)
This thesis aims at analysing the translation of the Paris Agreement from the official Spanish version to the Italian one. For this reason, the theoretical aspects are fully analysed as well as the more practical and translation-oriented ones. Starting from this point, legal translation characteristics and translation techniques are explained. In fact, translation methods and schools, such as Tel Aviv, and disciplines, for example the Translation Studies, are of great importance and therefore presented. All these elements contribute to the analysis of some articles of the Paris Agreement in its Italian version, which are compared to the official Spanish version. Thus, the similarities and differences between these two languages are appreciated thanks to the application of the theoretical part presented in the previous sections.
The abovementioned analysis allows also to understand that in Spanish exist many different language varieties. Being the second most spoken language in the world, with more than 496 million native speakers, every Spanish-speaking community has its own peculiarities, fact that leads to much incomprehension between native speakers (for example, Spanish-speaking people grew up in the Unites States). For this reason, and for the major meaning of the Paris Agreement, it was necessary to choose a linguistic variant that anybody could understand. As far as the Italian version is concerned, it can be seen that the language is very formal and authoritative, which is an important characteristic in official documents. The linguistic component is therefore of the utmost importance in this work.
Anyway, the linguistic perspective is not the only relevant one. In fact, the legal aspect plays a fundamental role as well. It is provided a definition of Law and it is explained in which way International Law is extremely important for this thesis. Moreover, the European Union Law and its influence in the Paris Agreement context are investigated as well. Then, the difference between the two most common legal systems in the Western area, common and civil law, is presented and it is also explained why this difference is overcome when it comes to international agreements.
Since the Paris Agreement was drafted by the United Nations, it is therefore necessary to show how this institutional body is structured. Additionally, the other two institutional bodies related to the Paris Agreement and of great relevance for the environment are explain thoroughly: the United Nations Framework Convention on Climate Change (UNFCC) and the Conference of the Parties (COP).
To conclude, it can be argued that the main focus of this thesis is a linguistic one, more specifically in the legal translation field. In fact, the Translation Studies have been of extreme importance in the last decades since the research in these fields allowed specific translation to be more accessible to translators. In spite of all this work, there is still a long way to go in order to guarantee appropriate translation means to legal and non-legal translators. Furthermore, a general classification of Law in its different fields of action is complementary to the linguistic part. Particular attention was paid to the International Law category, which comprehends all international treaties, like the Paris Agreement. Lastly, it should be noted that the comparative analysis of the two versions is found at the end of the thesis, after having explained the linguistic and the legal parts so that the reader could use his/her basic knowledge to understand the linguistic analysis.
