Riassunto analitico
Questa tesi si compone di tre capitoli, ognuno di essi incentrato sul fenomeno del whistleblowing, ossia la denuncia di illeciti alle autorità. Il whistleblowing si manifesta in diverse forme, ma in questa sede verranno trattati casi in cui il reato è stato commesso sul posto di lavoro, con l’intenzione di salvaguardare l’interesse pubblico. Nello specifico, i tre capitoli si focalizzano sulle alternative legali a cui i whistleblower possono ricorrere, ovvero le misure a loro dedicate per proteggersi da eventuali ritorsioni. Il capitolo uno presenta gli strumenti a salvaguardia del whistleblower a livello internazionale e soprattutto a livello europeo. Tra di essi, l’Articolo 10 della Convenzione Europea sui Diritti Umani si pone come apripista in quanto prevede la protezione per la libertà di espressione, che può essere applicata anche al whistleblowing. Il capitolo due invece introduce il caso italiano fornendo anzitutto il contesto di base partendo dal Decreto legislativo no. 231 dell’8 giugno 2001, da molti considerato come un primo approccio alla questione, seppur marginale. Infine, il terzo capitolo descrive il completo panorama italiano sul whistleblowing dal punto di vista legale, il quale comprende la Legge no. 179 del 30 novembre 2017 – ideata ad hoc – e la nuova Direttiva dell’Unione Europea no. 1937 del 23 ottobre 2019.

Abstract
This dissertation is composed of three chapters, all of them dealing with the phenomenon of whistleblowing, namely the reporting of illicit conduct to authorities. Whistleblowing can take many forms, but this paper is mainly centred on those cases of illegal activities that are detected by employees within their workplace, who decide to blow the whistle in an attempt to safeguard the public interest. In particular, the three chapters will focus on the legal framework that is available to whistleblowers, that is, the provisions that are available to them as a form of protection against retaliation.
Chapter one presents the legal alternatives that safeguard the phenomenon of whistleblowing at the international level and most importantly, at the European level. Among them, Article 10 of the European Convention on Human Rights leads the way in providing protection to the freedom of expression, and therefore, applying to whistleblowing as well.
Chapter two instead introduces the Italian case by providing a background on the issue of whistleblowing starting from Legislative Decree no. 231 of 8 June 2001, which sets out a first approach to the issue, though still marginal.
Finally, chapter three describes the complete Italian legal background on whistleblowing, which comprehends the Law no. 179 of 30 November 2017 – specifically designed to protect whistleblowers – and the new EU Directive no. 1937 of 23 October 2019.
