Il trasporto marittimo è un settore di importanza fondamentale per l'economia globale, poiché la maggior parte delle merci a livello mondiale viene trasportata via mare. La presente tesi si propone di esaminare in profondità il profilo giuridico del vettore marittimo nel contratto di trasporto di merci via mare e di fornire una panoramica completa degli aspetti legali in questo ambito. L’obiettivo di questa ricerca è infatti quello di contribuire a una migliore comprensione di questa importante componente del commercio internazionale e delle leggi che lo regolamentano. La tesi è strutturata in quattro capitoli, ognuno dei quali affronta aspetti specifici del campo del diritto della navigazione, partendo dalle fonti normative del diritto dei trasporti, passando per il contratto di trasporto di merci in generale e via mare, giungendo ad analizzare le obbligazioni e le responsabilità delle parti coinvolte, soffermandosi in particolare su quelle della figura del vettore. Il contesto legale italiano costituirà un punto di riferimento importante per l'analisi, in quanto si farà particolare attenzione all'unicum nel panorama giuridico internazionale rappresentato dal Codice della Navigazione italiano. Il primo capitolo si concentra sulle fonti del diritto dei trasporti e della navigazione. Vengono esaminate le diverse fonti normative del diritto dei trasporti e la loro gerarchia, offrendo una comprensione chiara della base normativa del diritto della navigazione. Vengono esaminati trattati internazionali, convenzioni, leggi nazionali e altre fonti che costituiscono il quadro giuridico per il diritto della navigazione. Si mette in evidenza l'importanza di queste fonti normative nell'armonizzare le leggi a livello nazionale e internazionale, garantendo la regolamentazione del settore. Il secondo capitolo approfondisce il contratto di trasporto di merci in generale. In questa sezione, vengono analizzati i profili giuridici dei soggetti coinvolti in questo tipo di contratto, con un focus speciale sulla figura del vettore. Vengono esaminate in dettaglio le obbligazioni e le responsabilità del vettore nei confronti del mittente e del destinatario, oltre alle leggi che regolano le sue azioni nei confronti del carico. Il terzo capitolo si concentra sul contratto di trasporto marittimo di merci e analizza le obbligazioni e le responsabilità del caricatore. In questo contesto, si esaminano le responsabilità del caricatore nel preparare e consegnare la merce al vettore marittimo, evidenziando il suo ruolo cruciale nella dinamica del trasporto marittimo di merci. Nel capitolo finale, vengono esaminate le obbligazioni e le limitazioni alla responsabilità del vettore marittimo, includendo un confronto tra la Convenzione di Bruxelles, i protocolli successivi dell'Aja-Visby e le regole di Amburgo. Questa sezione offre una visione completa delle normative internazionali che influenzano il vettore marittimo e i suoi doveri, insieme alle restrizioni legali che ne limitano la responsabilità in diverse circostanze. In sintesi, questa tesi contribuisce in modo significativo alla comprensione delle complesse dinamiche legali che circondano il vettore marittimo nel trasporto di merci via mare, offrendo un'analisi dettagliata delle fonti normative e della loro gerarchia, oltre a chiarire le obbligazioni e le responsabilità delle parti coinvolte. Il contesto legale italiano, con il suo Codice della Navigazione, costituisce un punto di riferimento significativo per questa ricerca, contribuendo a delineare un quadro completo del diritto marittimo applicato al trasporto marittimo di merci.

Abstract
Maritime transport is a sector of fundamental importance for the global economy, as the majority of goods worldwide are transported by sea. This dissertation aims to thoroughly examine the legal profile of the maritime carrier in the contract for the carriage of goods by sea and provide a comprehensive overview of the legal aspects in this field. As a matter of fact, the objective of this research is to contribute to a better understanding of this important component of international trade and the laws which regulate it.
The thesis is structured into four chapters, each addressing specific aspects of maritime law, starting with the regulatory sources of transport law, moving on to the contract for the carriage of goods in general and by sea, and finally analyzing the obligations and responsibilities of the parties involved, with a particular focus on those of the carrier. The Italian legal context will be an important benchmark for the analysis, as special attention will be given to the unicum in the international legal landscape represented by the Italian Navigation Code.
The first chapter focuses on the sources of transport and navigation law. It examines the various regulatory sources of transport law and their hierarchy, providing a clear understanding of the normative basis of maritime law, which includes international treaties, conventions, national laws, and other sources that make up the legal framework for maritime law. Then, the importance of these regulatory sources in harmonizing laws at both the national and international levels, which ensure the regulation of the sector, is highlighted.
The second chapter delves into the contract for the carriage of goods in general. In this section, the legal profiles of the parties involved in this type of contract are analyzed, with a special focus on the figure of the carrier. The obligations and responsibilities of the carrier towards the shipper and the consignee, as well as the laws governing the carrier's actions regarding the cargo, are examined in detail.
The third chapter focuses on the contract for the carriage of goods by sea and analyzes the obligations and responsibilities of the forwarder. In this context, the forwarder’s responsibilities in preparing and delivering the cargo to the maritime carrier are examined, highlighting their crucial role in the dynamics of the carriage of goods by sea.
In the final chapter, the obligations and limitations of the maritime carrier's liability are examined, including a comparison among the Brussels Convention, the subsequent Hague-Visby Protocols, and the Hamburg Rules. This section provides a comprehensive view of international regulations which influence the maritime carrier and their duties, along with the legal restrictions that limit their liability in different circumstances.
In summary, this thesis significantly contributes to the understanding of the complex legal dynamics surrounding the maritime carrier in the carriage of goods by sea, offering a detailed analysis of regulatory sources and their hierarchy, as well as clarifying the obligations and responsibilities of the parties involved. The Italian legal context, and in particular the Navigation Code, constitutes a significant benchmark for this research, contributing to outlining a comprehensive framework of maritime law applied to the maritime carriage of goods.
