La pandemia da COVID-19 ha sollevato molte questioni di carattere giuridico. In questa tesi è trattata la responsabilità degli enti ex art. 25-septies, d.lgs. 231/2001: il contagio da Covid-19 sul luogo di lavoro, se intergra lesioni gravi o gravissime, o se porta alla morte del lavoratore, potrebbe infatti far sorgere una responsabilità in capo all'ente. Più in particolare, nel caso di accertato reato (omicidio colposo o lesioni colpose commessi con violazione delle norme antinfortunistiche), da parte di soggetto apicale o sottoposto, compiuto nell'interesse o a vantaggio dell'ente, il giudice penale ben potrebbe sondare la responsabilità di quest'ultimo. In questa tesi sono quindi esposti i passaggi logico-giuridici necessari per addivenire alla dichiarazione di responsabilità collettiva; sono messe in luce le problematiche proprie del "sistema 231", alcune delle quali la pandemia ha reso particolarmente interessanti.

Abstract
The COVID-19 pandemic has raised many legal issues. This thesis discusses the liability of legal persons under Art. 25-septies, d.lgs 231/2001: a COVID-19 infection in the workplace could in fact arise liability on the part of the collective entity, if it intergraves serious or very serious injuries, or if it leads to the death of the worker. More specifically, in case of an ascertained crime (manslaughter or culpable injury committed in violation of accident prevention regulations) committed by an apical subject or subordinate, carried out in the interest or to the advantage of the legal person, the judge could consider the responsibility of the latter. In this thesis the logical-legal steps which are necessary to the declaration of collective responsibility are examined; the study highlights some peculiar issues of the “231 System”, that the pandemic has made particularly interesting.
