Riassunto analitico
L’elaborato di tesi affrontato si intitola “Il drafting legislativo e il procedimento normativo”. Come suggerito dal titolo, durante la redazione mi sono concentrata su due diversi aspetti: da un lato la dicotomia tra come sono scritte le leggi attualmente e come dovrebbero invece essere scritte, presentando un excursus storico che specifica quando e perché si è avvertita l’esigenza di individuare regole apposite per la redazione della buona legge (regole di drafting legislativo appunto); dall’altro le conseguenze che una legge scritta male produce all’interno dell’ordinamento, nello specifico nel procedimento di formazione delle leggi, andando ad analizzare il rapporto tra Parlamento e altri organi, Governo e potere giudiziario. L’elaborato di tesi si conclude dimostrando come vari studiosi ed esponenti della dottrina abbiano dato un importante contributo e impulso nello studio della materia del drafting legislativo, suggerendo strumenti adatti alla risoluzione del problema. Scopo della ricerca è quello di andare ad individuare non solo le conseguenze della legge scritta male, ma anche a verificare in quale modo si possa fronteggiare la situazione.

Abstract
This graduation thesis is entitled “The legislative drafting and normative process”. As suggested by the title, I focused on two different aspects: on the one hand the opposition between how the laws are written currently and how the laws would be written, introducing an historical excursus, that specifies when and why there has been the need to find specific rules for the drafting of a good law (legislative drafting rules indeed); on the other hand the consequences that a poorly written law produces in the judicial system, in particular in legislative process, analyzing the relationship between Parliament and the other authorities, like Government and Judiciary power. This graduation thesis ends showing as many academics and exponents of doctrine have given an important contribution and impulse in legislative drafting, suggesting appropriate ways for the resolution of the problem. So, the research purpose is to find not only the consequences of badly written law, but also in which way they can be faced.
