Riassunto analitico
Il lavoro di ricerca svolto nell’elaborato che segue, ispirato dalla visione dell’esordio cinematografico del francese Bruno Dumont, “La vie de Jésus”, si propone di analizzare la libertà di manifestazione del pensiero dal punto di vista storico-filosofico, attraverso la lettura delle opere di pensatori quali Baruch Spinoza, il quale, attraverso il “Trattato teologico-politico”, testo insieme di critica biblica, filosofia della religione e filosofia politica, sostiene che, in linea generale, lo stato incapace di garantire la libertà di pensiero e di espressione, pur essendo limitata in circostanze specifiche, abbia pochissime possibilità di sopravvivenza, gli inglesi John Milton, il quale, chiedendo l’abrogazione di un’ordinanza restrittiva della libertà di stampa votata dal Parlamento nel 1643, rivolgendosi ai Lord e ai Comuni d’Inghilterra, con il discorso “Areopagitica” denuncia l’inutilità della censura, e John Locke, il filosofo della Rivoluzione inglese, nel cui “Lettera sulla tolleranza”, culmine della ricerca sul fondamento della libertà di coscienza e di opinione, dopo la pubblicazione di numerosi scritti minori, si può leggere che «la libertà di coscienza è un diritto naturale di ciascun uomo», ammettendo, contestualmente, l’intervento statale, per ciò che concerne le questioni religiose ritenute pubblicamente rilevanti, fino ad arrivare agli apporti derivanti dal pensiero illuminista e dal modello liberale di libertà d’espressione, senza dimenticare il processo di positivizzazione avviatosi in America e in Francia a seguito delle due rivoluzioni settecentesche. Nel secondo capitolo, ad essere preso in considerazione, invece, è l’inquadramento, dal punto di vista giuridico, dell’hate speech, focalizzando, in particolare, l’attenzione sugli orientamenti espressi, nel corso del tempo, dalla Corte Europea dei Diritti dell’Uomo, nel nostro continente, e dalla Corte Suprema degli Stati Uniti d’America, passando, nel prosieguo, a mettere in luce gli aspetti emersi, sul tema, in altre nazioni, che hanno conosciuto, in diversi casi, regimi e conflitti intestini, concludendo con l’analisi del contesto italiano, ove si auspicano l’emersione di leggi chiare e la previsione di distinte fattispecie di reato, delineandosi, in questo modo, una strategia efficace in grado di muoversi entro i principi penali di tipicità e tassatività, le quali possano soddisfare le basilari esigenze di contrasto all’hate speech. Nella seconda metà del presente contributo, sono oggetto di studio sono l’utilizzo delle nuove tecnologie – come, detto altrimenti, introdurre un controllo dell’hate speech sulle piattaforme tecnologiche senza, naturalmente, limitare e, infine, censurare, il libero flusso di informazioni –, e, infine, le possibili strategie per contrastare, concretamente, la diffusione dei discorsi d’odio, nell’intento di far risaltare il ruolo fondamentale che ricoprono, come nel mondo reale, l’educazione e la cultura, affinché gli utenti, ispirati, in alcuni casi, dal linguaggio adottati dai politici abituati a generare divisioni in una data popolazione, si approccino alla rete senza recar danno alle vite degli altri.

Abstract
The research work carried out in the following paper, inspired by the vision of the film debut of the French Bruno Dumont, "La vie de Jésus", aims to analyze the freedom of expression of thought from the historical point of view-philosophical, through the reading of the works of thinkers such as Baruch Spinoza, who, through the "Theological-Political Treatise", text of biblical criticism, philosophy of religion and political philosophy, argues that, in general, the state which is unable to guarantee freedom of thought and expression, although limited in specific circumstances, has very little chance of survival, the English John Milton, which, by calling for the repeal of an order restricting freedom of the press voted by Parliament in 1643, addressing the Lords and Commons of England, with the speech "Areopagitica" denounces the uselessness of censorship, and John Locke, the philosopher of the English Revolution, in whose "Letter on tolerance", the culmination of research on the basis of freedom of conscience and opinion, following the publication of numerous minor writings, it can be read that «freedom of conscience is a natural right of every man», admitting, at the same time, state intervention, with regard to religious issues which are considered to be publicly relevant, to the extent of contributions arising from Enlightenment thought and the liberal model of freedom of expression, without forgetting the process of positivization that started in America and France following the two eighteenth-century revolutions. In In the second chapter, the legal framework for hate speech is taken into consideration, focusing, in particular, on the guidelines expressed over time by the European Court of Human Rights, in our continent, and by the Supreme Court of the United States of America, moving on, in the following, to highlight the issues that have emerged, on the subject, in other nations, which have known, in several cases, regimes and internal conflicts, concluding with the analysis of the Italian context, where the emergence of clear laws and the prediction of different types of crime are desired, thus developing an effective strategy capable of moving within the criminal principles of typicity and severity, which can meet the the basic requirements of contrast to hate speech. In the second half of this contribution, are studied are the use of new technologies - as, said otherwise, introduce control of hate speech on technological platforms without, of course, limiting and, finally, censorship, the free flow of information -, and, finally, possible strategies to combat, concretely, the spread of hate speech, with the aim of highlighting the fundamental role that they play, as in the real world, education and culture, so that users, inspired, in some cases, by the language adopted by politicians accustomed to generating divisions in a given population, approach the network without harming the lives of others.
