L’obbiettivo che si pone questa tesi è quello di presentare i lineamenti caratterizzanti la responsabilità dell’impresa di gestione aeroportuale.
The aim of this thesis is to present the features characterizing the responsibility of the airport management company. It can only be mentioned the problem of the manager's responsibility for the exercise of the handling activity or the qualification of the manager's activity as dangerous to the effects of art. 2050 cod. civ. The handling business falls within the area of services operated by the airport. With this term, it is primarily intended to indicate a complex of ground handling operations such as passenger and freight services, cleaning and maintenance of aircraft, and in summary all those necessary and ancillary operations at the start , Landing and parking of the aircraft. Regarding the qualification of the manager's activity as dangerous to the effects of art. 2050 cod. Civ., The latter issue, was the subject of a heated debate which was initiated by a judgment of the Genoa Tribunal of 5 October 2001 concerning a case of bird strike (collision between an aircraft taking off or landing and a flock Of birds). The Ligurian Court stated that, in the case of bird strike, the contractual liability of the airport operator and ENAV is inconsistent with the non-contractual liability of such persons for the purpose of carrying out a dangerous activity within the meaning of art . 2050 cod. civ. In addition, the manager's responsibility is that of the licensing authority (the Ministry of Infrastructure and Transport), if he has failed to exercise his powers of addressing, coordinating and controlling the activity of the concessionaire.
