Riassunto analitico
La dissertazione intende analizzare l’eredità del Concilio di Trento dalla sua chiusura, il 5 dicembre 1563, alla prima metà del XVII secolo attraverso il prisma che ne diffuse e «disperse» i provvedimenti. Nel 1564 forti tensioni furono generate intorno al destino del Tridentino, le cui sorti furono decise non nel luogo dei lavori assembleari ma a Roma. In questa direzione la tesi si propone di esplorare l’organo istituito allo scopo, rimasto a lungo trascurato dalla storiografia. La Sacra Congregazione del Concilio fu istituita da papa Pio IV il 2 agosto 1564 per gestire i decreti del concilio, vigilare sulla loro applicazione e interpretarne autenticamente il senso in caso di conflitti o questioni che fossero sorti sulla loro esecuzione in universo christiano orbe. Fino al XIX secolo essa rivolse la sua attività a regolamentare i dubbi di tutta la cristianità e a giudicare i casi afferenti a tutti gli ambiti toccati dalle disposizioni tridentine, da quelli patrimoniali e beneficiari, a quelli matrimoniali e disciplinari cambiando le sorti parimenti di laici e clerici, di individui, famiglie, comunità ed enti ecclesiastici. Attraverso la consultazione sistematica della documentazione del suo archivio, conservata nell’Archivio Segreto Vaticano, l’elaborato si propone di analizzare il funzionamento, le procedure e la struttura burocratica del dicastero in oggetto nel periodo che va dalla sua istituzione a commissione temporanea, passando per la riforma sistina che la trasformò in congregazione permanente, fino a giungere al pontificato di Urbano VIII e ai suoi primi provvedimenti restrittivi. I risultati dell’indagine sono riposti nell’osservazione delle modalità con cui l’arsenale giurisprudenziale che la congregazione elaborò nel corso del tempo si depositò, influenzando i modelli normativi locali. La ricerca ha permesso di prendere coscienza della forza di trasmissione e radicamento delle decisioni assunte dal centro romano; delle variegate forme assunte dalle relazioni tra gli episcopati e la Congregazione centrale, che non di rado agiva noncurante delle reti di interessi di cui gli ordinari tentavano di essere custodi gelosi. Non da ultimo il presente studio ha tentato di esaminare i rapporti tra la Congregazione del concilio e gli altri organi di curia, accomunati da un patrimonio di competenze che per la gran parte si sovrapponevano, oltreché da cardinali membri contemporaneamente di più dicasteri. L’esito del lavoro qui presentato ha voluto chiarire la complessità degli intrecci istituzionali della curia pontificia e il pluralismo dei livelli giurisdizionali centrali e periferici, attraverso uno sguardo ravvicinato sul modus procedendi di quella che divenne una delle più potenti congregazioni di curia che eliminò la necessità di ricorrere a un ulteriore concilio per i trecento anni successivi.

Abstract
Despite enormous challenges, the Council of Trent was brought to a close on 5 December 1563 and crucial is what occurred in the years immediately after. In fact, in 1564, a close and decisive battle was waged over the Council, but its center was not Trent, but Rome. This dissertation examines an under-studied component of the papal power in early modern era: the Sacred Congregation of the Council, established by Pius IV on 2 August 1564 to manage the Tridentine heritage. This action put the papacy at the head of the movement for the implementation of the Council and over against the confused and conflicting appreciation of the Council he directed that the authentic interpretation of the Council’s decrees be reserved to the Holy See and forbad that any commentaries on the Council be published without the authorisation of the Sacred Congregation of the Council. Instituted as cardinalitial commission, it became a permanent congregation under Sixtus V who on February 1588 with the bull "Immensa Aeterni Dei" promoted a general reorganisation of papal government. The Pope formalized its name and reaffirmed its responsibilities. Its main task was the interpretation and application of the Tridentine legislation and its activity was turned to regulate all the controversies risen from the Christendom. Thanks to its exclusive power to interpret and apply the decrees of the Council of Trent, the Congregation became a proper civil Court with judicial functions on very different matters, from property matters to marriage agreements. The working and the particular modus procedendi of this Congregation is the focus of this Ph.D thesis.
Questioned by lay and ecclesiastical people, the Sacred Congregation of the Council imposed on the Christendom a uniformity in its doctrine and practice that was never envisioned by the Council of Trent itself. The investigation on the Sacred Congregation of the Council will focus on the identification of their procedures from the beginning until the end of Sixtus V's pontificate. It seems particularly interesting to follow the development of the modus operandi of the Congregation during the period in which it passed from cardinalitial commission to the permanent congregation. Through the study of the roman sources, preserved in the Secret Vatican Archive, I intend to throw light upon their early mechanisms, procedures and structures between 1564 and 1650, from Gregory XIII through Sixtus V to Clement VIII. It would reserve a special attention to the cases concerning lay people and locate when the petitioners started appealing personally to Rome to defence their own interests. This dissertation intends point out the procurator and counsellor's action and its importance in relation to the bishop's role. Results suggest that the Sacred Congregation of the Council became one of the most powerful congregations that also eliminated the need of a council the next three hundred years.
