Riassunto analitico
Il cosiddetto doppio volto dello stato di necessità rompe l’impostazione dogmatica unitaria, in quanto esso, da un lato, si presenta come causa di giustificazione, trovando il proprio fondamento nel bilanciamento di interessi, dall’altro, si manifesta nella veste di scusante soggettiva che poggia la propria legittimazione sull’impossibilità di esigere dall’agente, in particolari situazioni di pericolo, un comportamento differente rispetto a quello posto in essere. Da qui la critica al concetto unitario di stato di necessità e la presa d’atto del contrasto insanabile tra una parte della dottrina che considera questa causa di esclusione del reato una mera causa di giustificazione o causa oggettiva di esclusione del reato, ed una altra parte che ritiene che si tratti, viceversa, di una scusante ovvero di una causa soggettiva di esclusione del reato. Inutile rimarcare la differenza tra i precipitati applicativi che seguono l’aderire ad una o all’altra concezione dello stato di necessità, così come impossibile distinguere in questa sede le diverse sottoricostruzioni italiane e straniere, compiute principalmente dalla dottrina più che dalla giurisprudenza, non solo di civil law ma anche di common law.

Abstract
The so-called double face of state of necessity breaks setting dogmatic unity as it, on the one hand, it presents as a cause of justification, finding its basis in the balancing of interests, on the other hand, manifests itself in the role of subjective excuse that rests its legitimacy on the impossibility of requiring the agent, in particular situations of danger, a behavior different from that in place.
From here the criticism of the concept of unity of necessity and acknowledging the contrast exists between a part of the doctrine that considers this grounds for exclusion of a crime merely because of justification or objective cause of exclusion of the offense, and another part it considers that it is, conversely, an excuse or a cause of subjective exclusion of the offense.
Needless to point out the difference between the precipitates applications that follow adhere to one or another conception of the state of necessity, as well as impossible to distinguish here the different under reconstruction Italian and foreign, carried out mainly by the doctrine rather than by law, not only civil law as well as common law.
