Riassunto analitico
Il disegno industriale e, in particolare, il car design costituiscono una della leve trainanti dell’industria italiana che si è da sempre riconosciuta per gli oggetti e le forme ideate dalla creatività ed estro dei suoi designer. La protezione del design rappresenta, pertanto, un elemento fondamentale per l’economia e per le imprese italiane, che hanno da sempre investito ingenti capitali nello sviluppo e nella ricerca del design, soprattutto in ambito automobilistico. Scopo della mia tesi è pertanto quello di analizzare e ricercare la migliore forma di tutela giuridica del car design. In particolare, dopo aver trattato l’industrial design e il car design, passo ad analizzare con estrema precisione le tre forme di tutela giuridica che l’industrial design può assumere e i relativi pro e contro di ciascuna forma. In primo luogo, il design può essere tutelato tramite il Codice della Proprietà Industriale che consente la registrazione come modelli e disegni delle forme del design industriale qualora sussistano i requisiti necessari. Seconda forma di tutela del design è fornita dal diritto d’autore (Legge 633/41) che offre ai prodotti e agli oggetti di design che abbiano “carattere creativo e valore artistico”, una protezione fino a settant’anni dopo la morte del loro autore, senza bisogno di alcun tipo di registrazione. Terza forma di tutela giuridica astrattamente prevedibile per le forme dell’industrial design è offerta dalla disciplina del marchio. Tale tutela è potenzialmente perpetua ma può essere riconosciuta solo a quelle forme che presentino, oltre ai canonici requisiti di protezione del marchio, un quid pluris in termini di capacità distintiva ovvero un “secondary meaning”, cioè un significato secondario ed ulteriore rispetto a quello intrinseco. Infine, la mia tesi affronta la problematica inerente ai pezzi di ricambio delle automobili. In particolare mi soffermerò sulle conseguenze che possono derivare dall’estensione della tutela del design ai pezzi di ricambio.

Abstract
Industrial and car design are one of the driving forces for italian industry. Italy is internationally recognised and appreciated for the objects and the products planned by the creativity and inspiration of its designers. That’s the reason why design protection is an essential element for Italian economy and companies willing to grow investing huge amounts in the design.
Especially in the car context, companies invest a lot of money in design research.
The purpose of my thesis is to search for and analyse the best car design-protection system.
First of all I will pass rapidly over the industrial design and car design.
In the first chapters I will rapidly deal with industrial and car design. In the subsequent chapters I am going to go into the details of the different existing systems for the protection of car design. In particular, I will analyse the pros and cons of each system.
First, industrial design can be protected through the Italian Intellectual Property Code (CPI). According to Article 31, the design can be protected through the registration. Moreover, the CPI establishes the “criteria” for protection (a design would have to be new and have individual character), fixes the duration of the protection and the limits.
In Italy there is an other system for the design protection under the Copyright Law (Legge 633/41). The Copyright Law provides a high level of protection for designs (creative and artistic works) that lasts all the author’s life and for seventy years after his death.
The Trademark system provides the third kind of design protection.
A shape, a colour, and a product appearance can be registered as a trade dress if it performs the essential trademark function and has distinctive character. Continued active use and re-registration can make a trademark perpetual.
In the end, my thesis deals with the challenge related to cars spare parts.
In particular, I will focus on the consequences that may result from the extension of the design protection to the spare parts.
