Riassunto analitico
Il lavoro di ricerca svolto, inerisce la tutela dei diritti sociali fondamentali dei tirocinanti legali, i quali, grazie ad una recente riorganizzazione degli uffici giudiziari avvenuta tramite legge, possono svolgere il loro praticantato presso i giudici per un periodo di 18 mesi. A tal fine, sono analizzate le problematiche relative ai diritti dei tirocinanti, sia rispetto alla normativa nazionale italiana, sia rispetto ai diritti garantiti dalla Carta dei Diritti Fondamentali dell’Unione Europea e dalla Convenzione Europea dei Diritti dell’Uomo, relativi alle condizioni di lavoro “sane, sicure e dignitose” ed alla protezione dei giovani sul luogo di lavoro, che devono essere “appropriate”; ancora, il tirocinante è garantito dallo “sfruttamento economico” e da ogni lavoro che possa minarne “lo sviluppo morale o sociale o possa mettere a rischio la loro istruzione”. A fronte di tali diritti, si è verificata la compatibilità del tirocinio con la tutela multilivello dei diritti e con la giurisprudenza delle due Corti sovranazionali (Corte d. i giustizia e Corte di Strasburgo). Inoltre si è soffermata l’attenzione sull’impatto oggettivo di questa modifica organizzativa dai diversi punti di vista. In primo luogo, sul lavoro del giudice, che i trova a gestire un vero e proprio ufficio, con uno staff, poi sul tirocinante, cioè sulla sua reale capacità di apprendere e di fruire di tale esperienza quale modalità di accesso al mondo del lavoro; in ultimo, si è analizzata la potenzialità che lo strumento del tirocinio può avere sullo smaltimento dei processi e sulla loro lunghezza, questione per la quale l’Italia è stata ripetutamente condannata dalla Corte internazionale dei diritti.

Abstract
The research work is inherent in the protection of fundamental social rights of legal interns , who, thanks to a recent reorganization of the courts occurred through law, can do their traineeship in the courts for a period of 18 months.
To this end, we analyze the issues related to the rights of interns, both with respect to the Italian national regulations, as with respect to the rights guaranteed by the Charter of Fundamental Rights of the European Union and the European Convention on Human Rights, related to "healthy, safe and respectable" working conditions and the protection of young people at work, which must be "appropriate " and further, the trainees are protected against the "economic exploitation" and against any work likely to harm “their moral or social development or to jeopardize their education".
In the face of such rights, it was verified the compatibility of the trainee with the multi-level protection of their rights and with the case law of the two supernational Courts (Court of Justice and Court of Strasbourg).
Also it has been focused attention on the objective impact of this organizational change from different points of view. Firstly, the work of the judge, that is to manage a real office, with a staff, then to the trainee, that is, on its actual ability to learn and benefit from such an experience as a mode of access to the labour market; finally, we analyzed the potential that the traineeship method may have on the disposal of processes and on their length, an issue for which Italy has been repeatedly condemned by the International Court of Rights
