Riassunto analitico
L'elaborato è incentrato sull'approfondimento del legame tra diritto e tipicità agroalimentari: il migliore strumento per valorizzare e tutelare un territorio ricco di storia, cultura, risorse agroalimentari e tradizioni come quello modenese appare ad oggi il diritto. Dalla disciplina privatistica della proprietà industriale, in particolare quella dei marchi individuali e collettivi, passando attraverso la regolamentazione delle indicazioni geografiche, si giunge ad analizzare la tutela offerta ad oggi dalle certificazioni di qualità comunitarie. Un’ulteriore considerazione viene fatta rispetto ad un prodotto tipico della tradizione gastronomica modenese che ancora non risulta aver ottenuto la registrazione comunitaria: il Tortellino di Castelfranco Emilia. Sono stati in questo breve scritto presi in considerazione i motivi che impediscono ancora oggi di tutelare e valorizzare questo prodotto, il dibattito sulla sua nascita e il collegamento con il territorio in cui storicamente viene prodotto. Nel formulare la proposta del riconoscimento IGP si è cercato di offrire una soluzione nuova per la tutela di questa eccellenza e uno spunto di riflessione sull'importanza di preservare le tradizioni locali e dell'adesione alle politiche di qualità europee.

Abstract
The elaboration focuses on the deepening of the link between law and agri-food typicality: the best tool to enhance and protect a territory rich in history, culture, agri-food resources and traditions such as the Modena one, today, appears to be the right.
From the privatistic regulation of industrial property, in particular that of individual and collective brands, passing through the regulation of geographical indications, we come to analyze the protection offered, up to now, by the Community quality certifications.
A further consideration is made with respect to a typical dish of the Modena tradition that has not yet obtained the community registration: the Tortellino of Castelfranco Emilia. In this short text, we analyzed the reasons that still today prevent to protect and enhance this product, the debate on its origin and the link with the territory in which it is historically produced. In formulating the proposal for the PGI recognition we tried to offer a new solution for the protection of this excellence and a starting point for reflection on the importance of preserving local traditions and adhering to European quality policies.
