Riassunto analitico
«Se foste stati voi ad essere aggrediti, cosa avreste fatto?». È questa la domanda cui è dedicato il presente elaborato. La tormentosa inquietudine della domanda di apertura è mossa dall’angoscia primordiale dell’ignoto, invero, perderebbe di senso senza quella oscura incertezza che la sorregge, così come la Notte stellata di Van Gogh sarebbe privata del suo fascino senza un cielo buio che la avvolge. È il non sapere «cosa fare» che supporta l’interrogativo: «voi cosa avreste fatto?». La pena incarna l’extrema ratio contro un illecito colpevole, la sfortuna di causare obiettivamente l’altrui lesione, percossa o morte non è meritevole di punizione penale.

Abstract
"If you had been the ones attacked, what would you have done?" This is the pivotal question of this dissertation. The unsettling nature of this opening query stems from the primordial fear of the unknown. In fact, it would lose its meaning without the murky uncertainty that sustains it, just as Van Gogh's Starry Night would be stripped of its charm without the enveloping darkness of the night sky. It is the very uncertainty of what to do that gives weight to the question: "What would you have done?" Punishment represents the extrema ratio against deliberate offences, but the mere misfortune of objectively causing harm, injury, or even death to others does not, in itself, warrant criminal punishment.
