Riassunto analitico
Lo sviluppo della scienza nell’ambito procreativo ha portato gli studiosi ad interrogarsi in merito a numerosi quesiti in ambito giuridico, morale e bioetico per quanto concerne i nuovi percorsi per la genitorialità e gli interessi dei vari protagonisti. La trattazione affronta l’analisi delle varie tecniche di procreazione – omologhe ed eterologhe – sia da un punto di vista scientifico che giuridico. Oltre alla legislazione, verranno approfonditi i casi giurisprudenziali più emblematici, in relazione con i vari diritti ed interessi dei protagonisti coinvolti. A seguire, verranno esposte le principali criticità legate ad una tecnica di tipo eterologo, ancora molto controversa: la gestazione per altri. Tutto ciò porterà all’approfondimento delle varie sfaccettature dei soggetti al centro di tali pratiche, nell’ottica di un’analisi di genere e un confronto con la tutela del nascituro. Infine, verrà analizzato l’istituto dell’adozione e le varie tipologie esistenti oggigiorno. Un particolare focus verrà dedicato al supporto psico-socio educativo, svolto da enti autorizzati, e delle varie teorie che hanno contribuito al corretto andamento del percorso adottivo.

Abstract
The development of science in the procreative field has led scholars to question numerous questions in the legal, moral and bioethical fields regarding new paths for parenthood and the interests of the various protagonists. The discussion deals with the analysis of the various procreation techniques - homologous and heterologous - from both a scientific and legal point of view. In addition to legislation, the most emblematic jurisprudential cases will be explored in depth, in relation to the various rights and interests of the protagonists involved. Following, the main critical issues related to a heterologous technique, still very controversial, will be exposed: gestation for others. All this will lead to an in-depth study of the various facets of the subjects at the center of these practices, with a view to gender analysis and a comparison with the protection of the unborn child. Finally, the institution of adoption and the various types that exist today will be analysed. A particular focus will be dedicated to psycho-social educational support, carried out by authorized bodies, and the various theories that have contributed to the correct progress of the adoption process.
